HOW DOES SkiMaster COLLECT, USE, SHARE AND PROCESS INFORMATION
SkiMaster relies on a number of legal bases to collect, use, share, and otherwise process the information we have about you for the purposes described in this Privacy Policy, including:
as necessary to operate the Application and fulfill our obligations pursuant to the Terms of Use.
where you have consented to the processing, which you can revoke at any time. For example, you may consent to the processing of health-related information;
where necessary to comply with a legal obligation, a court order, or to exercise and defend legal claims;
to protect your vital interests, or those of others, such as in the case
of emergencies;
where you have made the information public;
where necessary in the public interest; and
where necessary for the purposes of SkiMaster’s or a third party’s
legitimate interests, such as those of visitors, members or partners.
OUR LEGITIMATE INTERESTS
We process your information in furtherance of our legitimate interests, including:
providing and improving the Application. We do so as it is necessary to pursue our legitimate interests of providing and developing innovative and tailored offerings to our users on a sustained basis; and
keeping the Application safe and secure. We do so as it is necessary to pursue the legitimate interests of SkiMaster and its users in ensuring the Application is secure, and to protect against fraud, spam and abuse, etc.
WHAT PERSONAL INFORMATION DOES SkiMaster COLLECT?
Personal information you provide to us: We receive and store any information you enter on our Application or provide to us in any other way. The types of personal information collected may include your name, email address, phone number, birthday, Twitter, Instagram and/or Facebook usernames, use information regarding your use of our Application, browser information, ski or board gear, and address. We automatically receive your location when you use the Application. The personal information you provide is used for such purposes as allowing you to set up a user account and profile that can be used to interact with other users through the Application, improving the content of the Application, customizing the advertising and content you see, and communicating with you about specials and new features. We may also draw upon this personal information in order to adapt the services of our community to your needs, to research the effectiveness of our network and services, and to develop new tools for the community.
Information collected automatically: When you use our Application, SkiMaster automatically receives and records information on our server logs from your browser or mobile platform, including your location, IP address, cookie information, and the page you requested. We treat this data as non-personal information, except where we are required to do otherwise under applicable law. SkiMaster only uses this data in aggregate form. We may provide aggregate information to our partners about how our users, collectively, use our site, so that our partners may also understand how often people use their services and our Application. SkiMaster reserve's the right to anonymously track and report a user's in app activity.
Data collected and shared automatically
The Google Mobile Ads SDK collects and shares the following data types automatically for advertising, analytics, and fraud prevention purposes.
By default, the Google Mobile Ads SDK
Collects device's IP address, which may be used to estimate the general location of a device.
Collects user product interactions and interaction information, including app launch, taps, and video views.
Collects information related to the performance of your app and the SDK, including crash logs, app launch time, hang rate, and energy usage.
Collects Android advertising (ad) ID, app set ID, and, if applicable, other identifiers related to signed-in accounts on the device.
All of the user data collected by Google Mobile Ads SDK is encrypted in transit using the Transport Layer Security (TLS) protocol.
HealthKit;Motion & Fitness APIs:SkiMaster utilizes data provided by Apple’s HealthKit and Motion & Fitness APIs to collect health and fitness related information on behalf of Apple iOS and Watch OS users for display and use within the SkiMaster Application and website.
Personal location: Your current personal location will be shared with other SkiMaster users. If you prefer to only share your location with your "CRU" or would like to keep your location private, this functionality of SkiMaster can be altered within the privacy settings of the SkiMaster Application.
USE OF COOKIES
When you visit the SkiMaster Application, a cookie will be stored on your computer or device. Generally, cookies and similar technologies work by assigning to your browser or device a unique number that has no meaning outside of the Application. SkiMaster uses cookies for authentication purposes only. Most browsers accept coolies automatically. To manage the collection of information through cookies you can use the settings on your browser or mobile device.
HOW IS MY INFORMATION SHARED?
SkiMaster may share your personal information only as described below.
CRU: Your “CRU” can see the location and time of each of your check-ins, first name and last name, email, phone number, photo, home resort, karma points, ski/board gear, links to your Twitter, Instagram and Facebook accounts (if you have connected those accounts to your SkiMaster account), and a list of your “CRU”. We therefore urge you to think carefully about including any specific information you may deem private in status updates or check-ins, or other content (location or otherwise) that you create in our service.
HealthKit;Motion & Fitness APIs:For our users privacy, SkiMaster will never use or disclose to third parties data gathered in a health, fitness, or medical research context - including data from HealthKit APIs, Motion and Fitness APIs, or health-related human subject research - for advertising or other use-based data mining purposes other than improving health management, or for the purpose of health research, and then only with permission.
Agents: We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. Our agents do not have any right to use personal information we share with them beyond what is necessary to assist us, and they provide a comparable level of protection for your personal information.
Information shared with everyone: One of the primary reasons people use SkiMaster is to share content with others. Information such as your first name and last name, Karma points, leaderboard statistics including checkins and tracks associated with resorts, number of “CRU” members, photo, and ski/board gear may be available to other SkiMaster users.
SkiMaster FEATURES
SkiMaster service also has the following features that may allow you to share your information with others. Please remember that if you choose to provide personal information using certain features of the service, that information may be available to the wider SkiMaster community, or may be published on the SkiMaster website, which is subject to indexing by third party search engines.
SHARING WITH PARTNERS, IN CONNECTION WITH BUSINESS TRANSFERS, AND FOR THE PROTECTION OF SkiMaster AND OTHERS:
Our partners: In addition to the data sharing described above, we enter into relationships with a variety of businesses and work closely with them. In certain situations, these businesses may sell items or provide promotions to you through SkiMaster’s service.
Protection of SkiMaster and Others: We reserve the right to release personal information when we believe in good faith that release is necessary to comply with the law, including laws outside your country of residence; enforce or apply our conditions of use and other agreements; or protect the rights, property, or safety of SkiMaster, our employees, our users, or others. This includes exchanging information with other companies and organizations (including outside of your country of residence) for fraud protection and credit risk reduction.
IS PERSONAL INFORMATION ABOUT ME SECURE?
Your SkiMaster account personal information is protected by a password for your privacy and security. You need to prevent unauthorized access to your account and personal information by selecting and protecting your password appropriately, and limiting access to your computer and browser by signing off after you have finished accessing your account.
SkiMaster endeavors to safeguard user information to ensure that user account information is kept private. However, SkiMaster cannot guarantee the security of user account information. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.
The service may contain links to other sites, SkiMaster is not responsible for the privacy policies and/or practices on other sites. This privacy policy only governs information collected on SkiMaster.
INTERNATIONAL USERS
If you are located outside of the United States, please note that this site is hosted on computer servers in the United States. Therefore, your information may be processed and stored in the United States. As a result, United States federal and state governments, courts, or law enforcement or regulatory agencies may be able to obtain disclosure of your information through laws applicable in the United States. Your use of SkiMaster or the site or your submission of any personal information to us will constitute your consent to the transfer of your personal information outside of your home country, including the United States, which may provide for different data protection rules than in your country.
EU MEMBERS’ RIGHTS
If you are habitually located in the European Union, you have the right to access, rectify, download or erase your information, as well as the right to restrict and object to certain processing of your information. While some of these rights apply generally, certain rights apply only in certain limited circumstances. We describe these rights below:
Access and Porting
You can access much of your information by logging into your account. If
you require additional access or if you are not a SkiMaster user, contact
us at feedback@umshz.com.
Object
Where we process your information based on our legitimate interests
explained above, or in the public interest, you can object to this
processing in certain circumstances. In such cases, we will cease
processing your information unless we have compelling legitimate grounds
to continue processing or where it is needed for legal reasons.
Revoke consent
Where you have previously provided your consent, such as to permit us to
process health-related data about you, you have the right to withdraw
your consent to the processing of your information at any time. In
certain cases, we may continue to process your information after you
have withdrawn consent if we have a legal basis to do so or if your
withdrawal of consent was limited to certain processing activities.
Complain
Should you wish to raise a concern about our use of your information
(and without prejudice to any other rights you may have), you have the
right to do so with your local supervisory authority.
TRANSFERS
The Application is operated from the United States. If you are located
outside of the United States and choose to use the Application or
provide information to us, you acknowledge and understand that your
information will be transferred, processed and stored in the United
States, as it is necessary to provide the Application and perform the
Terms of Use. United States privacy laws may not be as protective as
those in your jurisdiction.
WHAT PERSONAL INFORMATION CAN I ACCESS?
SkiMaster allows you to access the following information about you for the purpose of viewing, and in certain situations, updating that information and ensuring that it is accurate and complete.
HOW IS INFORMATION REMOVED FROM MY ACCOUNT?
Even after you remove information from your account or profile, copies of that information may remain viewable elsewhere, to the extent it has been shared with others, it was otherwise distributed pursuant to your privacy settings, or it was copied or stored by other users. Removed and deleted information may remain on backup media for up to ninety (90) days prior to being deleted from our servers.

WILL THERE BE CHANGES TO THIS PRIVACY POLICY?
SkiMaster may amend this privacy policy from time to time. When we do, we will revise the “last updated” date at the top of the privacy policy. Use of information we collect now is subject to the privacy policy in effect at the time such information is used. If we make material changes in the way we use personal information, we will notify you by posting an announcement through our service or on our website or by sending you an email. Users are bound by any changes to the privacy policy when they use SkiMaster after such changes have been first posted. If you object to any of the changes to this Privacy Policy, you should stop using the Application and delete your account.
